General Terms and Conditions of Sale

Scope of Application

These General Terms and Conditions of Sale (GTCS) exclusively govern all sales of video games (new and used) concluded on the GameXPass website to customers who are consumers or non-professionals. The GameXPass site is currently in the process of legal registration. GameXPass reserves the right to modify its conditions at any time; the applicable conditions are those in force on the date of validation of the order by the buyer. By checking the dedicated acceptance box before finalizing his order, the Customer acknowledges having read these GTCS and accepts them without any restriction or reservation.

Orders

The acquisition of video games on the site is carried out according to the following process:
1. Selection of the video game(s) by the Customer within the online catalog.
2. Creation of a personal space or connection to an existing account by entering the required information (Last name, First name, email address, password, delivery address and telephone number).
3. Presentation of a detailed summary of the order including the chosen products, the overall price and any delivery costs for verification and correction of any errors.
4. Final validation of the order after express acceptance of these GTCS.
5. Entry and validation of secure payment data.
The sale becomes final after sending an order confirmation by email from GameXPass and collection of the full price due.

Prices and Invoicing

The prices of video games available in the catalog are indicated in Euros, all taxes included (VAT included). These prices are firm and do not include processing, shipping and delivery costs, which are calculated and displayed transparently just before the final validation of the order. GameXPass is free to change its prices at any time, but undertakes to apply the prices displayed at the exact time of order registration. A digital purchase invoice is systematically issued and made available to the Customer within his personal space as soon as his order is shipped.

Payment Conditions

Full payment of purchases must be made on the day of validation of the order by the Customer. Transactions are secure and are carried out via bank cards (Visa, MasterCard, or any other secure payment system integrated into the site). The actual debit from the Customer's bank account corresponds to the time of logistical preparation or shipment of the package. The commitment to pay by card is irrevocable, except for proven fraudulent use in accordance with the legal provisions in force. GameXPass reserves the right to suspend or cancel any shipment in case of payment default or pre-existing dispute with the buyer.

Delivery and Deadlines

The physical items ordered are shipped to the exact postal address provided by the Customer during his order. GameXPass undertakes to use all necessary means to deliver the products within a maximum period of thirty (30) days from the effective payment. Apart from cases of force majeure or address errors attributable to the Customer, if delivery is not made within this regulatory period, the Customer has the right to request in writing the resolution of the sale. All sums paid will then be refunded to him within a maximum period of fourteen (14) days.

Right of Withdrawal

In accordance with the provisions of the Consumer Code, the Customer has a legal period of fourteen (14) clear days from the day of receipt of his package to exercise his right of withdrawal without reason or penalty. Postal return costs are exclusively the responsibility of the Customer.
Important exclusion: In accordance with applicable legislation, the right of withdrawal cannot in any case be exercised for audio, video or computer software recordings (including video games on physical media such as CD, Blu-Ray, cartridges) that have been unsealed, opened or removed from their protective plastic film by the consumer after delivery. To be eligible for a refund, returned products must be perfectly new, sealed and in their original packaging. The withdrawal request can be sent via the site's contact form or by email to customer service. The refund will be made within 14 days of receipt and verification of the conformity of the returned product.

Legal Guarantees and Liability

GameXPass is responsible for the mandatory legal guarantees, namely the legal guarantee of conformity (articles L. 217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code). The consumer has a period of two years from delivery of the product to take action and is exempt from proving the existence of the conformity defect during the 24 months following delivery. In case of non-conformity or defective product upon opening, the Customer is invited to contact our customer service to proceed with a standard exchange of the video game or its full refund. The liability of GameXPass cannot be incurred in case of force majeure or abnormal or inappropriate use of the product by the Customer.

Personal Data Protection (GDPR)

As part of the order process, GameXPass collects personal data essential for proper logistical processing, delivery tracking and invoicing. In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, the Customer has at any time the right to access, rectify, delete, limit and port all of his personal data. These rights can be exercised simply by sending a written and justified request to the site's customer service or directly via the options in the personal space.
